Il rinnovo dell’Accordo Economico collettivo per gli Agenti di commercio del settore Industria, datato 30 luglio 2014 costituisce occasione per ripercorrere alcune della caratteristiche principali del rapporto di agenzia.
Il rapporto di agenzia, nella sua struttura “classica”, che vede da un lato il preponente organizzato in forma di impresa e dall’altra l’agente persona fisica, viene inserito dal punto di vista sistematico, tra i rapporti di lavoro autonomo. Trattasi, in particolare, di rapporto di lavoro autonomo regolato, sia nella fase genetica che nella successiva fase di gestione, da norme specifiche che consentono di individuarne sia gli elementi naturali che accessori.
Norme di legge – quindi fonti di primo grado – che si rinvengono principalmente nel codice civile (artt. 1742 e segg. c.c.) ma anche in altre disposizioni più specifiche dedicate a particolari figure di agenti quali ad esempio i promotori finanziari (D.Lgs. 24 febbraio 1998, n. 58).
Nonché norme contenute nella contrattazione collettiva di settore, quindi fonti secondarie di regolamentazione del rapporto di lavoro, le quali assumono un ruolo rilevante per la regolamentazione di dettaglio degli obblighi nascenti dal contratto.
Spiccano per importanza gli Accordi Economici Collettivi per il settore Industria e per il settore Commercio che svolgono una fondamentale funzione di regolamentazione del rapporto di agenzia quando ne ricorrano le condizioni di applicabilità, ossia fondamentalmente quando le parti vi abbiano espressamente fatto riferimento in modo esplicito od implicito ovvero quando le parti aderiscano alle organizzazioni sindacali che hanno sottoscritto gli Accordi.
